Application for a permanent residence permit for an EU citizen

As an EU citizen, you can apply for a permanent residence permit for your stay in the Czech Republic, usually after five years of continuous residence in the Czech Republic or after two years of continuous residence, if the EU citizen is simultaneously a family member of another EU citizen who has been granted permanent residence in the Czech Republic or is simultaneously a family member of a citizen of the Czech Republic.

You are an EU citizen and you have continuously resided in the territory of the Czech Republic on a longer-term basis.

Provided that certain conditions are met, you can file an application for a permanent residence permit.

These conditions are either continuous residence in the Czech Republic for a period of five years; or if you are a family member of another EU citizen who has been granted permanent residence in the Czech Republic or if you are a family member of a citizen of the Czech Republic, you can file an application for a permanent residence permit as early as after two years of your continuous residence in the country.

You can file an application for a permanent residence permit for an EU citizen after five years of continuous temporary residence in the territory of the Czech Republic.

Or you can file an application for a permanent residence permit for an EU citizen after two years of continuous temporary residence, provided that you will be filing the application for a permanent residence permit for an EU citizen as a family member of a citizen of the Czech Republic or as a family member of another EU citizen who is already residing in the country with a permanent residence permit.

An application for a permanent residence permit for an EU citizen is to be filed exclusively in person on a duly filled out application form.

The forms are available on the Information Portal for Foreigners. 

As an EU citizen, you can apply for a permanent residence permit particularly:

A) after 5 years of continuous residence in the territory of the Czech Republic

File your application on a filled out application form, to which you will enclose all the required documents specified below*:

• a travel document /an identity document (it is necessary to submit the original of the document);
• a document confirming compliance with the condition of 5-year continuous temporary residence;
• 2 photographs;
• a proof of accommodation.

B) after 2 years of continuous temporary residence in the Czech Republic – as a family member of another EU citizen

File your application on a filled out application form, to which you will enclose all the required documents specified below*:

• a travel document /an identity document (it is necessary to submit the original of the document);
• a document confirming the fact that you are a family member of another citizen of the European Union or a citizen of the Czech Republic;
• a document confirming compliance with the condition of 5-year continuous temporary residence;
• 2 photographs;
• a proof of accommodation.

*The documents required to be enclosed with the application must not be older than 180 days, with the exception of the travel document, the vital records certificate and the applicant’s photograph, as long as it corresponds to their actual appearance. It is always necessary to submit the originals or officially authenticated copies of the documents. As for the travel document and the vital records documents to be submitted, their originals must be submitted.

The application, along with the appropriate documents, is to be filed at an office of the Department for Asylum and Migration Policy of the MOI (DAMP MOI); the most suitable office would be considered the office with territorial jurisdiction over the applicant’s registered place of residence.  

It is always necessary to submit the originals or officially authenticated copies of the documents. The original of the travel document or the originals of the vital statistics documents will be returned to you after their copies are made on the spot.

Jaký má služba benefit

You will receive a residence permit for a citizen of the European Union, which is issued for a period of 10 years, after which it can be extended, also repeatedly.

Možnosti odvolání

You can appeal against the decision within 15 days of the delivery of the decision. You can file the appeal in person or send it by mail (or electronically) to the given office of the MOI CR or to the head office of the MOI.
