Supreme supervision of the Czech Mining Authority

The Czech Mining Authority performs the supreme supervision:

• compliance with the Mining Act, the Mining Activity Act and regulations issued pursuant to them, if they regulate the protection and use of mineral deposits, operational safety, securing protected objects and interests from the effects of mining activities and the handling of explosives,
• compliance with the Mining Act, the Mining Activity Act and regulations issued pursuant to them and other generally binding legal regulations governing occupational safety and health, safety of technical equipment, underground fire protection and working conditions in organizations when performing mining activities, or activities carried out in the mining method and in the handling of explosives,
• over ensuring the safe condition of underground structures.

For the purposes of supervision, it is necessary to have documentation in paper form, which relates to mining activities or activities performed in a mining manner, or explosives handling or operation of an underground facility.

These are in particular:

• plans for opening, preparation and mining of exclusive deposits,
• plans for the use of non-reserved mineral deposits,
• documentation of blasting works,
• mining survey documentation,
• geological documentation,
• construction documentation of underground structures.

As part of the exercise of its supreme supervision, the Czech Mining Authority may be contacted by post to the address of its registered office, or by personal filing at the filing office or orally in the minutes.

In certain cases, it is also possible to communicate via printed forms of the AIS SBS public portal.

Možnosti odvolání

The possibilities of remedies are governed by the Administrative Procedure Code. The Czech Mining Authority sometimes acts as an appellate body, but sometimes also as a first-instance body. 

If the Czech Mining Authority makes a decision in the first instance, an appeal can be filed against its decision, within 15 days of notification of the decision; the chairman of the Czech Mining Office decides on dissolution.

You cannot further appeal against the decision in the second instance (submit a dissolutionl).
