Adjudication of a dispute between a citizen and their employer on the correctness of the entry in the pension insurance record sheet - the application is handled by the DSSA

This is a service in which a decision is made about the accuracy of the entry on your record and by your employer.  If a person who is not a member of the armed forces disagrees with the employer's entry on the pension insurance record sheet and the employer fails to correct it at the request of the person, the person may request the district social security administration to resolve the dispute.

In a dispute between you and your employer, the District Social Security Administration can only decide on the correctness of the entry in the pension insurance record sheet on the basis of a request made by you.

If you apply after 30 days have elapsed from the date of receipt of a copy of the record sheet, the district social security administration may decide to waive the delay.

To use this service, you must make a written request clearly specifying what you are requesting, stating which entry on which registration certificate you find a discrepancy and your birth number at the same time. This written request does not have a prescribed binding model.

Step    1
You can send a request for a decision in a dispute between you and your employer about the correctness of an entry in the record sheet, which does not have a prescribed format:

• in person at the district social security administration, in Prague at the Prague Social Security Administration, and in Brno at the Municipal Social Security Administration in whose district the employer's department where the payroll records are kept is located.
• by post directly to the address of the competent social security administration in whose district the employer's department where the payroll records are kept is located.
• Addresses of individual social security administrations can be found on the website of the Czech Social Security Administration.

Step    2
If you miss the 30-day deadline from the date of receipt of a copy of the record sheet from the employer for filing a request for a dispute resolution between you and the employer, the district social security administration may decide to waive the delay. This decision is not open to appeal and is also excluded from judicial review.

Step    3
The District Social Security Administration will assess the correctness of the entry on the pension record sheet and decide your dispute with your employer. If it agrees with you and finds that the entry in the registration certificate is incorrect and needs to be corrected, the district social security administration will issue and then send you a reasoned written decision stating, among other things, which entry in the registration certificate should be corrected and how. If the District Social Security Administration does not grant your request because it finds the entry in the registration certificate that you dispute to be correct, it will issue and subsequently send you a written decision stating the reasons for not granting your request.

Step    4 
If the district social security administration has decided that the entry in the record sheet that you dispute needs to be corrected, the employer is obliged to correct the entry. The employer submits the record sheet with the corrected entry to the Czech Social Security Administration for storage in its records, issues one of the copies of the registration sheet to you as its employee and stores the other in its records.

Jaký má služba benefit

If your employer refuses to correct an entry in the pension insurance record sheet with which you disagree, e.g. the period of participation in pension insurance, the assessment base, excluded periods, you can obtain the correction of this entry by a decision of the district social security administration in a dispute between you and your employer. The employer is obliged to correct the entry in the record sheet and its copy as decided by the district social security administration.

Možnosti odvolání

The decision may be appealed within 15 days of receipt with the district social security administration that issued it. The Czech Social Security Administration decides on the appeal. The decision on the appeal is issued by the Czech Social Security Administration within 30 days of receipt of the appeal, although this deadline is again extended by the time limit set for the issue of the opinion, which is 60 days. The deadline may be extended, if necessary, by the time it takes to investigate the relevant facts.
