Termination of tutorship

Tutorship terminates if at least one of the parents of the person under tutorship acquires parental responsibility, or the ability to exercise it. Tutorship is also terminated if the child acquires legal capacity, or if they are adopted.

The office of a tutor is terminated upon the death of the tutor, or by a court decision depriving the tutor of, or removing them from, their office.

A court will deprive a tutor of office if the tutor so requests for important reasons, or if the person discharging the office of tutor loses the eligibility to do so.

A tutor is responsible for the proper discharge of their office and is subject to constant supervision by a court. A court will remove from office a tutor who breaches their tutorship duties. A court will consider the removal of a tutor if it finds reasons for which it is not appropriate for the tutor to continue to discharge their office.
