A child’s parents always have a maintenance and support obligation towards them, whether or not they are married.
The maintenance and support obligation of a parent to a child is not tied to parental responsibility. A child’s right to maintenance and support does not expire upon the age of majority, on the acquisition of full legal capacity, nor on the suspension, limitation or revocation of parental responsibility. The maintenance and support obligation cannot be waived, cannot be transferred to another person, and it is not time-barred. Both parents have a maintenance and support obligation towards the child.
Other relations (i.e. grandparents, great-grandparents) also have a maintenance and support obligation towards a child. However, the maintenance and support obligation of parents towards a child takes precedence over the maintenance and support obligation of grandparents and other relations towards a child.
