If a parent does not exercise their parental responsibility properly and if required by the interests of the child, a court will limit their parental responsibility or its exercise, while determining the scope of this limitation.
If a court limits the parents’ rights and obligations from parental responsibility, it means that the parent loses these rights and obligations and will no longer have them. The other parent not limited in parental responsibility will also exercise parental responsibility for the first parent. If both are limited, or if there is no second parent, a court will appoint a guardian for the child who exercises parental responsibility to the extent to which the child’s parent’s parental responsibility has been limited.
Before a court decides on limiting parental responsibility, it will always consider whether, given the best interests of the child, it is necessary to limit the parent’s right to personal contact with the child.
The limitation of a parent’s parental responsibility does not affect the parent’s duty to maintain and support the child.
