Bankruptcy declaration

In cases of bankruptcy, an insolvency court decides on a bankruptcy declaration as a separate ruling. In exceptional cases, this ruling may be combined with an insolvency decision (if the debtor is unable to draw on reorganisation or debt relief). A bankruptcy declaration takes effect when the decision to declare a debtor bankrupt is published in the insolvency register. No special conditions need to be met for a bankruptcy declaration as this is a general way of addressing the debtor’s situation that is permissible in all cases.
