Administrative Gender Change – Entry in the Civil Registry and Implications for First Name and Surname

The date of gender change is considered to be the date stated in the certificate issued by the healthcare provider (attending sexologist) confirming that the conditions for gender change have been met. Together with the request for an additional entry of the gender change in the birth register, the person whose gender has been changed may make a declaration to change their first name(s) and surname. The registry office will make an additional entry in the birth register regarding the gender change. The individual whose gender has been changed may make a declaration to use a different first name(s) and surname before any registry office.

A person who has undergone a gender change must appear at the registry office that maintains their birth record, presenting the certificate issued by the healthcare provider (attending sexologist) confirming that the conditions for an administrative gender change have been met. The attending sexologist issues this certificate if diagnostic procedures have conclusively confirmed the diagnosis of transsexualism in the individual concerned.

The registry office may also receive the certificate confirming the fulfillment of conditions for gender change directly from the healthcare provider.
The registry office will then make an additional entry in the birth register regarding the gender change and, through the Ministry of the Interior of the Czech Republic, assign the person a new birth identification number.

Together with the request for an additional entry of the gender change in the birth register, the individual whose gender has been changed may declare that they will use a different first name(s) and surname.
If the individual did not make a declaration to use a neutral first name(s) and surname at the start of treatment for gender change and did not make such a declaration after the gender change when requesting the additional entry in the birth register, the registry office will record the surname in the birth register in a form corresponding to the new gender in accordance with Czech grammar rules. As for the first name, the registry office will not enter it in the birth register and will notify the court of this fact.

After making the additional entry regarding the gender change, the registry office will issue a birth certificate indicating the new first name(s), surname, gender, and birth identification number.
