Request for removal of a child

Main information

The director of a diagnostic institute may, at the reasoned written request of the legal representatives of a child, a child or an adult client (or the institution in which the child is placed, OSPOD, or on his or her own initiative), decide to transfer a child with protective upbringing to another children’s home with a school or an educational institute. In administrative proceedings, the Director decides on the removal of the child, in accordance with Act No. 109/2002 Coll., on the performance of institutional education or protective education in educational establishments and on preventive educational care in educational establishments and on the amendment of other acts.

You are a parent of a child, a child (or an adult client) who, on the basis of a court decision imposing protective care, has been placed in a school institution for the performance of institutional care or protective care (children's home with a school or educational institution).

What is the benefit of this service

A child (or adult client) placed in a school facility for institutional education (children's home with a school, educational institution) is allowed to move to another more suitable facility on the basis of the reasons given.

Appeal options

You can lodge an appeal against the decision to remove the child through the director of the establishment that issued the decision; he will forward it with the relevant documents to the superior administrative body - the Ministry of Education, Youth and Sports. The appeal shall be duly substantiated.
