A foreign investor who intends to make a foreign investment in Czechia that is subject to mandatory screening, must apply for a permit from the Ministry of Industry and Trade, and in their application must provide the information required by law.

When to use this service
The service must be used prior to the actual implementation of a foreign investment in Czechia if it is a transaction subject to mandatory screening.
Service settlement
What you need if you are using this service
A foreign investment screening application form, which can be found on the website of the Ministry of Industry and Trade. You must enter the following information into the form:
- the trade name or name, registered office and the law under which the legal person was established, if a legal person, or the name, or names, and surname, registered office address and permanent residence address, also the temporary place of residence if different from the permanent residence address if a natural person, and the personal identification number, if assigned,
- the name, or names, and surname, permanent residence address, also the temporary place of residence if different from the permanent residence address, telephone number, e-mail address and date and place of birth of members of the statutory and supervisory bodies of a legal person or other management bodies of a legal person,
- information on the ownership structure, including information on the ultimate investor and who controls the foreign investor, the amount of their interest and any changes in these facts over the last year,
- information on products or services and trade and business activities, including information on selected economic indicators and, where applicable, sectoral regulation and special statutory regulation governing the foreign investor’s business in the country of residence, on the basis of which the foreign investor has received a permit to conduct business in that country, if such a permit is required in that country,
- a list of the European Union Member States in which the foreign investor carries on business activity, including information on subsidiaries and branches in those states,
- the source of financing for the foreign investment,
- the amount of the foreign investment,
- the date of completion or planned completion of the foreign investment,
- the business name or name, registered office and identification number of the target person, if allocated, or the name and address of the target asset,
- information on the ownership structure of the target person or the owner of the target asset prior to the foreign investment, including information on the ultimate investor and on who controls the target person or the owner of the target asset and the amount of their interest,
- information on the products or services produced or provided by the target person or in the target asset and on the trade and business activities of the target person or the owner of the target asset, including information on selected economic indicators,
- a list of the European Union Member States in which the target person or the owner of the target asset carries on business, including information on subsidiaries and branches in those states,
- information on the target person’s involvement in projects or programmes of European Union interest and
- the direct or indirect interest of the foreign investor in the ownership and voting rights in the target person or the corresponding influence before and after the foreign investment, including information on the interests of persons subject to unified management and persons acting in concert.

What is the benefit of this service
If you, as a foreign investor, apply for a screening of your foreign investment in Czechia in accordance with the law, you will gain legal certainty as to whether or not your investment is in accordance with the principles for protecting the security of Czechia, and thus the option to decide whether or not to implement the investment.
Appeal options
A negative decision, which is by law subject to a government resolution, cannot be appealed or reviewed in a review procedure. An action against such a decision or an application for revision of the proceedings which gave rise to such a decision cannot be granted suspensory effect.

If you, as a foreign investor, make a foreign investment subject to mandatory screening without submitting an application for a permit, you face a fine of up to 1% of the total net turnover achieved in the last completed accounting period, or from CZK 50 000 to CZK 50 000 000 if the total net turnover for the last completed accounting period cannot be ascertained.
