Allowance to cover the needs of a child

Main information

Allowance to cover the needs of a child is a benefit that replaces child maintenance. The eligible person is a dependent child entrusted to foster care/guardianship, the benefit is provided if the conditions of the law are met up to the age of 26. For a child over 15 years of age, a certificate of dependence must be provided with the application.

This applies to you if

You are a foster parent or personal guardian of a minor child or a temporary foster parent or a natural person who has been entrusted with the care of a minor child pursuant to Section 953 of the Civil Code or an adult child who was entrusted to foster care or guardianship until reaching adulthood.

When to use this service

You can apply for the service if you are a foster parent, a personal guardian of a minor dependent child or a person who has had a minor dependent child entrusted to their care under Section 953 of the Civil Code.

A dependent minor child placed in foster care or in the care of a natural person pursuant to Section 953 of the Civil Code is entitled to an allowance to cover the child's needs. The allowance is paid to a foster parent, a personally caring guardian or a natural person to whose care the minor child was entrusted pursuant to Section 953 of the Civil Code.

The entitlement to a child's needs allowance continues after the child reaches adulthood, but not longer than until the age of 26, if the child is a dependent child under the law governing state social support who lives permanently and jointly pays for their needs with the person who was the caregiver (foster parent/personal guardian) until the child reached adulthood. The allowance shall be paid to the child from the instalment of the child's needs allowance due for the calendar month following the month in which the child reaches adulthood.

You can use the service if you are an adult dependent child who was placed in foster care or guardianship until reaching adulthood.

What you need if you are using this service

When applying for the foster care benefit – allowance to cover the needs of a child, you will need to fill in a form Application for foster care benefit – allowance to cover the needs of a child.

Please attach to the application:

  • an identity card,
  • birth certificate for children under 15 years of age or if the birth surname is not included on the identity card,
  • residence permit – for foreigners.

A decision of the regional authority on inclusion in the register of persons who may perform foster care for a temporary period (Section 27a (1) to (3) of the Act on the Social and Legal Protection of Children), if the person is a registered person.

A decision to entrust the child to the care of another person responsible for the child's upbringing (a court decision to entrust the child to foster care, a court decision to entrust the child to foster care for a temporary period, a court decision to entrust the child to pre-foster care, a court decision to appoint a guardian of the child if the guardian personally cares for the child, a decision on entrusting the child to the personal care of another natural person pursuant to Section 953 of the CC) or a petition filed with the court to initiate court proceedings for entrusting the child/children to foster care, pre-foster care or for appointing a guardian of the child or a resolution on initiating proceedings for entrusting the child to foster care or pre-foster care or for appointing a guardian of the child, if initiated ex officio.

Current court decisions on the determination of maintenance for children who have been entrusted to the personal care of another natural person pursuant to Section 953 of Act No 89/2012 Coll., the Civil Code, as amended.

An affidavit of the person, on the initial date of personal care of the child, who has filed a petition for the child's placement in their foster care or pre-foster care or a petition for their appointment as guardian, or of the person who is personally caring for the child during the proceedings for the child's placement in their foster care or pre-foster care or for their appointment as guardian of the child, if the proceedings have been initiated ex officio. The affidavit must be submitted on a form prescribed by the Ministry.

A statement by the municipal authority of the municipality with extended powers that the applicant is personally caring for the child, if the proceedings for foster care, pre-foster care or appointment of a guardian have been initiated ex officio, or that the applicant is personally caring for the child and this care is not manifestly unjustified, if the applicant themself has filed a petition with the court for the child to be placed in foster care, pre-foster care or for their appointment as a guardian of the child (Article 3 of the Act, if the application is made by a person pursuant to Section 2a(c)(2) or (3) of the Child Protection Act).

For dependent children after the end of compulsory schooling and always from the age of 15:

  • certificate of studies or decision to interrupt studies in connection with pregnancy, childbirth or parenthood or health certificate or certificate of inability to train for a future occupation or to engage in gainful activity due to illness or injury or certificate of registration in the records of the Labour Office of the Czech Republic for job seekers after the end of compulsory schooling up to the age of 18.

In the case of children who receive a pension from pension insurance, the decision on the awarding of the pension and a certificate of its amount (decision of the CSSA, Military Social Security Office, Department of Social Security of the MoI or another payer).

Decision on the level of dependency of the child entrusted to the assistance of another natural person.

Applications should be submitted at the contact point of the Czech Labour Office according to the place of permanent residence (place of residence) of the individual. What is the benefit of this service

The allowance to cover the needs of a child will be used by a person who is a foster parent, a personal guardian of a minor dependent child or a person to whose care the minor dependent child has been entrusted pursuant to Section 953 of the Civil Code, to cover the costs related to the needs of that child.

The allowance will be used by an adult child who has been placed in foster care or guardianship until adulthood to pay for costs related to their needs.

Appeal options

If you are not satisfied with the outcome of a foster parent remuneration procedure, you may submit an appeal against the ‘decision’ within 15 days of receiving that decision. Submit your appeal with the regional branch of the Labour Office of the Czech Republic that made the decision on the benefit. The Ministry of Labour and Social Affairs will then decide on your appeal.
