The legal status of a long-term European Community resident is granted exclusively to third-country nationals.

You are a third-country national, not a citizen of the EU.

To receive this status, you must meet the following conditions:

  • 5 years of continuous residence in the Czech Republic;

  • you have not seriously the disrupted public order or threatened the national security of the Czech Republic or another Member State of the European Union;

  • you have provided evidence that you have funds for permanent residence in the Czech Republic.

If you are a family member of an EU citizen and a third-country national, and you have applied for a permanent residence permit after 5 years of continuous temporary residence, the MOI CR will grant you the legal status of a long-term European Community resident in the Czech Republic, if you explicitly request this in your application for a permanent residence permit and if your application is granted.

If this status has not been granted to you simultaneously with the granting of your permanent residence permit, it can be granted additionally after the requirements for its granting are met.

When you apply for permanent residence after 5 years of continuous residence in the Czech Republic, you may also file an application for the status of a long-term European Community resident.

If you have already received a permanent residence permit, you can apply for the status of a long-term European Community resident additionally anytime.

You must file the application on a duly filled out application form. The forms are available on the Information Portal for Foreigners

Enclosed the following required documents with the application*:

  • a travel document (it is necessary to submit the original of a valid travel document);

  • documentary evidence that you have funds for permanent residence in the Czech Republic.

*The documents required to be enclosed with the application must not be older than 180 days, with the exception of the travel document, the vital records certificate and the applicant’s photograph, as long as it corresponds to their actual appearance. It is always necessary to submit the originals or officially authenticated copies of the documents. As for the travel document and the vital records documents to be submitted, their originals must be submitted.

An application for the status of a long-term resident is to be filed at the office of the MOI CR.

If you are a family member of an EU citizen and a third-country nationala biometric certificate of residence permit will be issued to you in addition to the certificate of permanent residence permit, along with a note on the granting of the legal status of a resident.

If you are a family member of an EU citizen and a third-country national, a biometric certificate will be issued to you in addition to your certificate of permanent residence permit, along with a note on the granting of the legal status of a resident.

In this context, you will be requested to provide your biometric data, to undergo subsequent verification of your biometric data and to collect the certificate in person for a fee of CZK 500. 

If you apply in person, the administrative fee must be paid by credit card at a Ministry of the Interior office.

If you apply by post, the administrative fee must be paid by bank transfer via the payment details generator on the Information Portal for Foreigners.

Jaký má služba benefit

You will also acquire the status of long-term resident in the European Community with your family member's permanent residence permit.

Residents have an advantage over other third-country nationals if they want to settle in another EU Member State. However, even this directive does not completely remove all barriers and does not put residents' rights on an equal footing with EU citizens.

Možnosti odvolání

You can appeal against the decision within 15 days of the delivery of the decision. You can file the appeal in person or send it by mail (or electronically) to the given office of the MOI CR or to the official address of the MOI:
