Entering the birth of a child in the book of births serves to record children born in the Czech Republic and to record the birth of Czech citizens abroad.

The birth of a child in the Czech Republic is registered by the registry office at the place of birth of the child.

The birth of a Czech citizen abroad is registered by the municipal office of the Brno-střed district (special register).

Based on the entry in the birth register, a birth certificate is issued (usually) to the child's parents. This is a document evidencing the birth of a child, its name and surname and who its parents are.

Births of children born in health care facilities, or born with the assistance of a doctor, are reported by these health care facilities or the doctor.

In other cases a birth is reported by

  • a parent 
  • a legal representative of a parent
  • a court-appointed guardian
  • by a natural person (individual) who has learned of the birth of the child (if the birth has not already been reported by the health care facility, the child's parents, their legal representative or a guardian)

Notification of birth shall be made at the latest within 3 working days of the birth of a child:

  • the health care facility where the child was born or the doctor who was at the birth (or treated the mother immediately after the birth)
  • in the case of birth outside a health care facility, the child's father or guardian.

In the case of the birth of a child outside a health care facility, where the father cannot make the notification:

  • the notification shall be made by the child's mother no later than 3 working days from the moment when she is able to make the notification.

In the event of the birth of a child outside a health care facility, where a notification was not made by the child's parents or guardian:

  • a natural person (individual) who has learned of the birth of a child shall make a notification no later than 3 days from the day on which he/she learned of the birth.

Notification of the birth of a child is done in person or by mail. 

When recording the birth of a child in the register of births (a process following the reporting of a birth) you will prove your identity as a parent (at least one of you) (by presenting valid proof of identity – identity card, travel document, foreigner's residence card).

If the child was born in a health care facility and the mother was identified by this facility, you do not have to appear in person at the registry office for registration if you have provided the registry office with all the data needed to register the child's birth (these can also be sent by post or via the health care facility where the child was born).

In the case where the child was born outside a health care facility, to record the birth of a child the registry office must identify at least one of the parents (on the basis of a submitted identity document).

To record the birth of a child, you will also provide:

1. for a child born during a marriage

  • marriage certificate
  • agreement of the parents on the name or names of the child,
  • the parents' agreement on the child's surname, if the information on the child's surname is not apparent from the marriage certificate of the child's parents,
  • if necessary, other documents needed to establish or verify the accuracy of the information entered in the register of births;

2. in the case of a child born outside marriage for whom paternity has been established

  • the agreement of the parents on the name or names of the child,
  • agreement of the parents on the determination of paternity or the written consent of the man who gave artificial insemination, confirmed by the health service provider, or a court's decision on the determination of paternity for the child,
  • birth certificates of the child’s mother and father,
  • final divorce judgement if the child's mother is divorced or the husband's death certificate if the child's mother is widowed,
  • if necessary, other documents needed to establish or verify the accuracy of the information recorded in the register of births;

3. in the case of a child born outside of marriage, whose father is not known, declaration of the child's name or names,

  • declaration of the name or names of the child,
  • mother's birth certificate,
  • final divorce judgement if the child's mother is divorced or the husband's death certificate if the child's mother is widowed,
  • if necessary, other documents needed to establish or verify the accuracy of the information entered in the register of births.

You do not have to submit the marriage certificate, birth certificates of parents and documents on the marital status of the mother in situations where these data are registered in their current form in the Population Register or the foreigner's information system.

Birth records are made by:

  • registry offices (municipal authorities, offices of city districts in Prague, authorities of city districts and city districts in territorially divided statutory cities, district authorities),
  • The Brno-střed district office in the case of citizens whose birth took place abroad.

You can apply for a birth certificate to be issued:

  • at the competent Czech registry office based on the place of birth of the child,
  • in the case of a citizen born abroad at the Brno-střed district office.

Jaký má služba benefit

The registration of a child in the state public register (civil register) makes it possible to prove his/her identity and that of his/her parents. It is, for example, a necessary prerequisite for the issue of a travel document to a child, for various child-related social benefits to be claimed, etc.

  • a decision not to record the birth of a child in the register of births

Deadline for filing an appeal:

  • 15 days from delivery of the decision

To be submitted to:

  • the authority which issued the contested decision

Who rules on it:

  • the superior regional authority

In case of errors in the register or birth certificate you can request its correction and the issue of a corrected birth certificate (free of charge).

For failure to issue a birth certificate within the statutory deadlines (30 days from notification of the birth) you can apply for measures against inactivity to the superior regional authority.

Sankce

For failure to notify the birth of a child, you maybe fined for the offence if you had a notification obligation. The fine can be a maximum of CZK 10,000.
