Exclusion of a person from the circle of joint foster care

Main information

The purpose of the service is to exclude a person from the circle of persons who would otherwise be considered a jointly assessed person for the purposes of determining the amount of the foster parent's allowance by law. 

You are applying as a claimant for foster carer's allowance.

This applies to you if

• You are a foster carer and have not lived with your spouse for more than three months.
• You are a person who is a personal carer and you have not been living with the other personal carer for more than three months.

When to use this service

You can apply for the service at any time if you are a foster parent or personal carer and have not lived with your spouse for more than three months.

What you need if you are using this service

When you file a Request to Exclude a Person from Shared Foster Care, you will need to complete the Request to Exclude a Person from Shared Foster Care form. 

The form can be obtained in paper form at the contact offices of the Labour Office.

Please attach the following to the application:

• an ID card;
• residence permit – for foreigners;
• divorce petition;
• the court's decision to dissolve the marriage;
• a court decision on the adjustment of relations with the children in your care;
• a proposal for the adjustment of relations with the children entrusted to their care.

Where and how to solve this service

Applications should be submitted at the contact point of the Czech Labour Office according to the place of permanent residence (place of residence) of the individual.

You can submit an application to exclude a person from a group of jointly assessed persons on the website of the Labour Office of the Czech Republic or Integrated Portal of the Ministry of Labour and Social Affairs.

When submitting electronically via the website, you must own a data box or have a qualified electronic signature certificate.

What is the benefit of this service

The benefit of the service is the exclusion of a person with whom you have not lived for more than three months from the circle of joint foster care/guardianship. 

The person's foster carer's allowance will be withdrawn.

Appeal options

If you are not satisfied with the outcome of the procedure to exclude a person from a group of jointly assessed persons, you can appeal against the Decision within 15 days of its delivery. 

Submit your appeal with the regional branch of the Labour Office of the Czech Republic that made the decision on the benefit. The Ministry of Labour and Social Affairs will then decide on your appeal.
