If you want to cut trees outside the forest, i.e. on land that you own or co-own, or lease, etc., you must apply to the locally competent nature protection authority (most often the municipality where the trees are located) for a permit to cut the trees . If you do not own the land or only co-own it, it is always necessary to have the consent of the owner or co-owner.
You do not need to apply for a permit if you want to cut trees with a trunk circumference of up to 80 cm measured at a height of 130 cm above the ground. However, it is also necessary to pay attention to the case when woody plants do not reach these dimensions, but form a continuous, so-called connected woody plant. You can cut a continuous tree stand without permission only if the total area of the felled stands does not exceed 40 m2.
You do not need a permit for stands of energy trees or Christmas trees, if the period between harvests does not exceed 10 years, and also for fruit trees growing on land in a built-up area, which are kept in the land register as a kind of land garden or built-up area and courtyard.
Human-intentional planted trees grown for fruit production can be considered as fruit trees. These are:
gooseberry, currant, peach, pear, apple, dark-fruited, Moravian common crane (sweet-fruited), quince, hazelnut, almond, apricot, mulberry, walnut, raspberry, blackberry, plum, cherry, sour cherry.
The above-mentioned possibilities of felling without a permit do not apply to cases where these trees form part of a so-called significant landscape element, tree line or in the case of replacement plantings, which were previously imposed by the nature protection authority as compensation for ecological damage caused by felling of trees.
If the felling of trees is to take place due to the implementation of a building plan approved in the zoning procedure, or in the joint zoning and construction procedure, you apply in a similar way and at the same authority for a binding opinion on felling of trees, while your own permit for felling trees will be issued by the relevant building authority.
