A temporary residence permit of an EU citizen’s family member is type of a residence permit for stays longer than 90 days intended for third countries citizens who are family members of EU citizens, citizens of Norway, Liechtenstein, Iceland, Switzerland and the Czech Republic, and subject to conditions also for citizens of the United Kingdom.
You can apply for a temporary residence permit of an EU citizen’s family member if you are a family member of an EU citizen and you are going to stay in the Czech Republic for a period longer than 90 days.

You must submit the application at the latest within 3 months from the date you entered the Czech Republic or from the date your previous residence permit expired. If you become a close family member of an EU citizen only when already residing in the Czech Republic, you must submit the application within 3 months from the date you have become a close family member of an EU citizen.

*The documents required to be enclosed with the application must not be older than 180 days, with the exception of the travel document, the vital records certificate and the applicant’s photograph, as long as it corresponds to their actual appearance. It is always necessary to submit the originals or officially authenticated copies of the documents. As for the travel document and the vital records documents to be submitted, their originals must be submitted.
The application form along with the appropriate documents is to be filed at the office of the Department for Asylum and Migration Policy of the MOI, ideally according to your registered address.

Upon application you must pay an administrative fee 200 CZK. The administrative fee must be paid by credit card at a Ministry of the Interior office.
If you are staying in the Czech Republic as an EU citizen’s family member, you can work here without an additional permit (you have a free access to the labour market). You can also work during the time that you are waiting for a decision on your application – a visa sticker in your passport is sufficient. You can repeatedly leave and re-enter the Czech Republic for the whole duration of your residence permit’s or residence card’s validity. You can also travel within the Schengen Area without a visa.
If your application is granted, an employee of the Ministry of the Interior will apply for a personal identity number for you. This does not apply to foreigners who have already received a personal identity number.
You can appeal against the decision within 15 days of the delivery of the decision. You can file the appeal in person or send it by mail (or electronically) to the given office of the MOI CR or to the head office of the MOI.
