The Convention on the Rights of the Child enshrines the obligation to respect the child’s right to preserve their identity, including their name. The name consists of a given (non-hereditary) name and a surname.

Determining a child’s name is primarily the responsibility of the parents. Only if the parents do not choose the child's name will a court determine their name.
