A succession right is a right to an estate or to a pro rata share thereof. An estate comprises the entirety of the deceased’s assets, with the exception of rights and obligations which relate exclusively to the person of the deceased, unless recognised or claimed as a debt before a public authority.
A person holding a succession right is an heir, and the estate to which an heir is entitled is known as their inheritance.
A succession right arises on the death of the deceased. A person who dies before or at the same time as the deceased does not have a succession right.
The acquisition of an inheritance is confirmed by a court in succession proceedings.
