Consumer rights when purchasing goods

A consumer is any person who, outside the scope of his/her business activity or outside the scope of the independent exercise of his/her profession, concludes a contract with an entrepreneur or otherwise deals with him/her.

When purchasing goods, the seller is responsible for the fact that the goods are free from defects (i.e. in particular that the goods correspond to the agreed description, type and quantity, quality, functionality, compatibility, interoperability and other agreed characteristics, are suitable for the agreed purpose and are supplied with the agreed accessories and instructions for use; or, if not agreed, the goods must correspond to quality, functionality, durability or other characteristics which the consumer may normally expect).

Furthermore, products placed on the market must be safe and must not endanger the health of the consumer.

In the case of defective or dangerous goods, the consumer has a number of rights. First of all, they can complain to the seller. They can also, where appropriate, claim compensation for the damage caused (compensation for damage caused by a dangerous product can be claimed from the manufacturer or another entrepreneur in the supply chain). If the consumer fails to resolve the dispute directly with the entrepreneur, he can turn to an out-of-court dispute resolution body. The consumer is also entitled to file a complaint with a supervisory authority (e.g. the Czech Trade Inspection Authority) and, if the conduct of the entrepreneur constitutes an offence, the entrepreneur will be fined.

Consumer disputes can be resolved within the framework of the out-of-court dispute resolution system by the Czech Trade Inspection, the Energy Regulatory Office, the Czech Telecommunications Authority or the Financial Arbiter.
