A registered partnership is void or is not established for reasons laid down by law.
A registered partnership is not established if a declaration is vitiated by a material defect, in particular by the lack of a freely made and complete expression of will, or if a declaration is made in error in relation to the legal act of the establishment of a registered partnership. Nor is a registered partnership established if neither of the persons making the declaration was a Czech citizen at the time they made the declaration, or if the registered partnership was entered into on the basis of false information intentionally provided in the documents required for the declaration by one of the individuals entering into the registered partnership.
If a registered partnership is established despite the fact that entry into the registered partnership was not permissible due to a statutory prohibition, a court will annul the registered partnership. An annulled registered partnership is considered not to have been established.
Anyone who demonstrates that they have an interest in the case may apply to a court for a declaration that a registered partnership has not been established or is void. The court may also decide of its own motion that a registered partnership has not been established or is void.
