In compliance with the laws each citizen is entitled to choose principally
- Type of the final disposal (burial/cremation)
- Details of the funeral,
- Specific place of the funeral,
- Setting and type of funeral (Church, civic,
without ceremony etc.),
- Select and rent a burial plot at any public burial ground.
The operator of a funeral home shall carry out the treatment of the body of a deceased, transfer and funeral in person. In case of entrusting another entity with the performance of any of such actions, it shall ne responsible therefore to the full extent as if it conducted them on its own. The mandate contract with the operator of a funeral home should, however, be in a written form and shall always contain:
- Identification of contracting parties
- Subject-matter
- Price of contracted services
- Date of conclusion of the contract
- Date of funeral
- Remuneration for the procurement thereof
The content of the mandate contract concluded with the operator of a funeral home, crematorium or a public burial ground according to the Civil Code must include a precise description and scope of ordered services, which must be confirmed by the provider of funeral services which bears full responsibility therefore. It may derogate from the requirements of the person authorizing funeral only if this is necessary in his/her interest or if it cannot obtain his/her consent in time. Following the funeral, the relevant provider of funeral services shall be obligated to hand the statement of the services effectively provided over to the contracting party (the person authorizing funeral).
Under the Consumer Protection Act the mandator has a legal title to conduct his/her own check on contracted services in compliance with the contract concluded with the relevant operator. An authorized person in charge of handling contingent complaints, shall be present on the premises throughout working hours. Claims shall be resolved no later than within 3 working days.
Funeral Welfare
The municipality shall be the only accountable person authorizing funeral, procurement of a burial plot included. The Ministry of Regional Development (MRD) reimburses meaningfully disbursed costs for the funeral of a destitute deceased under the Decree of the MRD No. 277/2017 Coll., Procedure by the Municipality in Securing a Decent Final Disposal. In respect of a negligible property of the testator, it belongs to the municipality as a reward for authorizing the funeral. In the case of affluent testators, heirs refund the costs of a final disposal and securing the burial plot to the municipality (see provisions of § 1701 of the Civil Code).
