Extending the validity of a card – temporary residence permit for a family member of an EU citizen

SERVICE DESCRIPTION

If the period of validity of your residence card for a family member of an EU citizen is about to expire, you are required to apply with the MOI for extension of its validity.

THIS APPLIES TO YOU, IF you are a holder of a residence card for a family member of an EU citizen. Before its validity expires, you are required to apply for extension of its period of validity. All this is based on the assumption that you intend to continue to reside in the territory of the Czech Republic.

SERVICE OUTPUT

Extension of the period of validity of a residence card for a family member of an EU citizen. When the validity of a residence card is to be extended, a new residence card is usually issued. 

WHEN TO USE THE SERVICE

As a holder of a residence card for a family member of an EU citizen, you must file an application for extension of the period of validity of your residence card before its validity expires.

WHAT YOU NEED IF YOU USE THE SERVICE ELECTRONICALLY

An application for extension of the period of validity of a residence card is to be filed on a duly filled out application form.

The forms are available on the website of the Ministry of the Interior.

The following will be enclosed with an application for extension of the period of validity of a temporary residence card for a family member of an EU citizen*:

  • a travel document;
  • a proof of medical insurance (this is not required, if the purpose of residence is employment, business or another gainful activity);
  • a proof of accommodation;
  • a document confirming that you are staying in the territory of the Czech Republic together with an EU citizen;
  • 2 photographs (only if the applicant’s appearance has changed or if a new card is to be issued).

*The documents required to be enclosed with the application must not be older than 180 days, with the exception of the travel document, the vital records certificate and the applicant’s photograph, as long as it corresponds to their actual appearance. It is always necessary to submit the originals or officially authenticated copies of the documents. As for the travel document and the vital records documents to be submitted, their originals must be submitted.

WHERE AND HOW TO USE THE SERVICE ELECTRONICALLY

Send your filled out application, along with the documents, in accordance with the Rules of Administrative Procedure to the official contacts of the MOI by e-mail with an advanced electronic signature, with all attachments being in the format of authorised conversion (via the filing office of the MOI CR), or to the data box (to DB MOI CR). You may possibly be requested to submit the original of the passport or the originals of the vital statistics documents.

HOW MUCH YOU WILL PAY FOR THE ELECTRONIC PROCESSING

Extension of a residence card for a family member of an EU citizen is free of charge.

WHAT YOU NEED IF YOU USE THE SERVICE IN PERSON OR BY MAIL

WHERE AND HOW TO USE THE SERVICE IN PERSON; WHERE TO SEND THE DOCUMENTS BY MAIL

The application, along with the appropriate documents, is to be filed at an office of the Department for Asylum and Migration Policy of the MOI (DAMP MOI). 

Alternatively, you can send your filled out application form, along with the documents, in accordance with the Rules of Administrative Procedure by mail to the official contacts of the MOI or directly to the office of DAMP MOI. It is always necessary to submit the originals or officially authenticated copies of the documents. Do not send the original of the travel document by mail; you may possible be requested to submit the original of the passport.

HOW MUCH YOU WILL PAY FOR USING THE SERVICE IN PERSON OR BY MAIL

Extending the validity of a residence card for a family member of an EU citizen is free of charge.

OPTIONS FOR APPEAL

You can appeal against the decision within 15 days of the delivery of the decision. You can file the appeal in person or send it by mail (or electronically) to the given office of the MOI CR or to the head office of the MOI.

SANCTIONS

If you fail to fulfil your obligation to file an application for extension of the period of validity of a residence card for a family member of an EU citizen, you will commit a minor offence, for which you face an on-the-spot fine of up to CZK 5,000.

LANGUAGE OF THE CASE

All submitted documents must be in the Czech or Slovak language or must be officially translated into Czech.
