As a rule, both parents are the legal representatives of a minor.
The status of the parents as a child's legal representatives is based on parental responsibility. Both parents have equal parental responsibility and each parent has it, unless they have been deprived of it. Parental responsibility is exercised by the parents in accordance with the best interests of the child and by mutual agreement. Parents have a duty and a right to represent a child in legal proceedings where the child does not have legal capacity. The parents represent the child together, however each of them acts independently.
