SERVICE DESCRIPTION
If an EU citizen is born in the territory of the Czech Republic, the same rules apply to him/her as to all EU citizens, and therefore his/her legal guardian is not required to apply for any residence permit for the child’s stay in the Czech Republic.
If the legal guardian of the newborn EU citizen is staying in the Czech Republic and is a holder of a permanent residence permit, the legal guardian may apply, on behalf of the newborn EU citizen, for a permanent residence permit with the office of the MOI CR on humanitarian grounds.
THIS APPLIES TO YOU, IF you are an EU citizen and a child was born to you in the territory of the Czech Republic. You may apply for a permanent residence permit for the child.

WHEN TO USE THE SERVICE
You will address this situation, if a child (an EU citizen) was born to you in the territory of the Czech Republic and you wish to apply for permanent residence of the child.
If an EU citizen is born in the territory of the Czech Republic, the same rules will apply to him/her as to all EU citizens and the child’s legal guardian is not required to apply for any residence permit for the child’s stay in the Czech Republic.
If the legal guardian of the newborn EU citizen is staying in the territory of the Czech Republic and is a holder of a permanent residence permit, the legal guardian may apply for a permanent residence permit for the newborn on humanitarian grounds.
If the legal guardian files this application within 60 days of the child’s day of birth, the child will be covered by the public medical insurance system from his/her birth until the moment when the decision takes legal effect.

WHAT YOU NEED IF YOU USE THE SERVICE IN PERSON
An application for a permanent residence permit is to be filed as a duly filled out application form. The application forms are available on the website of the Ministry of the Interior.
The documents required to be enclosed with an application for a permanent residence permit for an EU citizen are*:

the child’s travel document; as a substitute for this, a travel document of the foreign national (the legal guardian), in which the child is entered, can be submitted

the child’s birth certificate
*The documents required to be enclosed with the application must not be older than 180 days, with the exception of the travel document, the vital records certificate and the applicant’s photograph, as long as it corresponds to their actual appearance. It is always necessary to submit the originals or officially authenticated copies of the documents. As for the travel document and the vital records documents, their originals must be submitted.
WHERE AND HOW TO USE THE SERVICE IN PERSON
The application with the required documents is to be submitted in an office of the Department for Asylum and Migration Policy of the MOI (DAMP MOI).

HOW MUCH YOU WILL PAY FOR USING THE SERVICE IN PERSON
The processing of an application for a permanent residence permit for an EU citizen is free of charge.
OPTIONS FOR APPEAL
You can appeal against the decision within 15 days of the delivery of the decision. You can file the appeal in person or send it by mail (or electronically) to the given office of the MOI CR or to the head office of the MOI.
